Privacy Policy

When you sign up for our App, we collect the email address and password to create your account and provide our services. This email address is your primary login credential and is used to communicate with you about important updates or support inquiries.

We also collect general device information to maintain the App’s functionality and improve compatibility. This information includes the device model, which helps us identify any compatibility issues specific to certain devices; operating system version to understand whether the OS version allows us to optimize the App for different systems; Unique Device Identifiers (UDI) to help us track App installations and troubleshoot technical issues. We do not use them to identify individual users.

We do not collect any personal identifiable information (“PII”) directly from the video content itself. However, depending on the content, it may inadvertently capture sensitive information such as, but not limited to landmarks, buildings, or street signs that could reveal the user’s location, especially in less populated areas. Uploading videos from highly recognizable locations could potentially expose a user’s home or workplace; Bystanders or passengers in the video may be identifiable if their faces are not obscured. This could include capturing individuals engaged in specific activities or wearing distinctive clothing; Vehicle Registration plates or other identifying features of vehicles may be captured in the video.

By using our App, you acknowledge and agree to the following:

• You understand the distinction between Personal Information and User Data as explained above.

• We collect, use, and disclose User Data, excluding Personal Information, for various purposes outlined in our Privacy Policy, including analysing uploaded videos, improving the App, and providing customer support.

• We reserve the right to use User Data for research purposes and for improving the App’s functionalities. We will never use User Data in a way that can directly identify you.

Your continued use of the App signifies your acceptance of these terms.

We will not share any Personal Information about users with third parties without their consent. However, we may share User data with third parties for research or improvement of the App. The Digital Personal Data Protection Act, 2023 (hereinafter referred to as the “Act”) grants you significant control over your personal information collected by our App. We are committed to upholding your rights under the Act. Here’s how you can manage your information:

You have the right to access your Personal Information that we hold. You can request a copy of your information by contacting us at support@terramatic.ai. We will provide the information in a format that is easily accessible and usable. If any of your personal information is inaccurate or incomplete, you have the right to request its correction. We will take reasonable steps to update your information promptly.

Users have the right to request deletion of their Personal Information, subject to certain exceptions. These exceptions may include where the information is required to comply with legal obligations or for the establishment, exercise, or defence of legal claims. You have the right to receive your personal information in a structured, commonly used, and machine-readable format. This allows you to easily transfer your information to another service provider if you choose. To request your data portability, please contact us at support@terramatic.ai.

We use the information collected for the following purposes:

• Analyze uploaded videos and generate reports on road conditions:
  We use the video uploaded by the users to identify and analyse road issues like potholes, cracks, or uneven surfaces. We may extract non-personally identifiable information from the video, such as lane markings, traffic signs, or road type, to improve the accuracy of our reports. We do not track or store any PII extracted from the video content uploaded by the user.

• Maintain and improve the App’s functionality:
  We use the aggregated data about user behaviour within the App to identify and fix bugs or improve user experience. This may include data on the types of videos uploaded, the frequency of use, or common user actions. We will never use individual user data for these purposes.

• Provide User Support:
  We may use device information to diagnose technical issues users may encounter while using the App. We may use information about user reports or inquiries to improve our user support processes.

Additionally, we may use the aggregated data for research purposes to improve the App’s ability to detect road conditions. We will always anonymize data before using it for research. The user hereby acknowledges that we may share such research and date with third parties without requiring user consent.

We want to emphasize that neither users nor Terramatic have the ability to anonymize data within the App. The App does not provide any built-in features or tools for anonymizing videos. By uploading a video, users acknowledge that they understand the limitations of the App regarding data anonymization.

Users acknowledge and agree that they are solely responsible for any data uploaded to the App. Terramatic shall not be liable for the failure to anonymize such data. Users understand that any PII, sensitive data, or other identifiable content uploaded to the App may be accessible to others and may pose privacy risks. Users agree to indemnify and hold Terramatic, its affiliates, officers, directors, employees, agents, and licensors harmless from any claims, damages, or liabilities arising out of the user’s failure to anonymize sensitive information in their uploaded videos.

WE CANNOT GUARANTEE THAT ANY DATA UPLOADED TO THE APP WILL BE ANONYMIZED. USERS SHOULD EXERCISE CAUTION WHEN UPLOADING VIDEOS THAT MAY CONTAIN SENSITIVE INFORMATION. It is recommended that users carefully review their videos for any PII or sensitive content before uploading them to the App.

Users acknowledge and agree that they are solely responsible for any data uploaded to the App. Terramatic shall not be liable for the failure to anonymize such data. Users understand that any PII, sensitive data, or other identifiable content uploaded to the App may be accessible to others and may pose privacy risks. Users agree to indemnify and hold Terramatic, its affiliates, officers, directors, employees, agents, and licensors harmless from any claims, damages, or liabilities arising out of the user’s failure to anonymize sensitive information in their uploaded videos.

This Privacy Policy and your use of the App are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to this Privacy Policy or your use of the App shall be finally settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of the arbitration shall be Surat, Gujarat, India. The language of the arbitration shall be English. The dispute shall be resolved by a sole arbitrator appointed by Vegneta Private Limited. The decision of the sole arbitrator shall be final and binding on all parties.

If any provision of this Privacy Policy is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

This Privacy Policy and the Terms of Use constitutes the entire agreement between you and us regarding the use of the App and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

We encourage you to review this Privacy Policy periodically for any updates. We reserve the right to modify this Privacy Policy at any time without prior notice.
